Art. 1 Terms and definitions

1.1 NutriStandard is dedicated to building an online service that promotes healthy food and a balanced lifestyle. The services, technologies, software products and their features, that NutriStandard LTD provides, including the NutriStandard.com website and mobile applications, will be called later in this document as NutriStandard Services.

1.2 NutriStandard Services are dedicated to people interested in the topic of healthy food and nutrition, health enthusiasts, experts, and food providers. Beneficiaries of the NutriStandard Services or persons that access NutriStandard.com or the NutriStandard mobile applications and agree with the Terms and Conditions of Use, will be referred to as Users.

Art. 2 NutriStandard Services

2.1 NutriStandard LTD offers free or paid services to its Users, on the website NutriStandard.com and on the NutriStandard mobile applications.

2.2 NutriStandard Services consist of the following:
- Offering an environment where the Users can connect, discover, share and discuss food and healthy lifestyle options.
- Ensuring that Users have a positive, inclusive and safe environment.
- Constantly developing technologies and putting them in the help of NutriStandard user community.
- Making all necessary efforts to maintain a stable infrastructure that supports the NutriStandard Services.

2.3 NutriStandard LTD will strive to maintain a pleasant environment for its Users that is safe, secure, and in accordance with the law.

2.4 Availability of the NutriStandard platform and services depend on the limitations and technical availabilities. NutriStandard LTD will strive to ensure high availability of the platform and services, however NutriStandard LTD assumes no liability in the unlikely cases when the services are unavailable.

2.5 NutriStandard services may be temporarily interrupted due to maintenance and improvements or due to external factors not related to NutriStandard. In all of these cases, NutriStandard LTD is not responsible for the unavailability of the services.

2.6 While using the NutriStandard website or mobile applications Users may encounter performance or development errors. NutriStandard LTD does not take responsibility for the errors that Users may encounter. NutriStandard LTD will endeavour to minimize the number and the gravity of these situations, and kindly asks the Users to report the encountered errors to the NutriStandard team as quickly as possible.

Art. 3 NutriStandard Users

3.1. NutriStandard strives to become a positive environment for its Users and foster a community bonded by common interests regarding food and lifestyle choices.

3.2 In order to provide a pleasant environment that is safe, secure, and in accordance with the law, NutriStandard also relies on its users to act accordingly and any deviation from a normal and peaceful conduct (example: licentious language, nude images/videos, spam, copyright infringement etc.) will force NutriStandard to permanently close that user account and restrict future access.

3.3 Users are required to adhere and to the following requirements in order to make use of the NutriStandard Services:
- Users must be at least 18 years old.
- Users must not be prohibited to receive the NutriStandard Services according to applicable laws.
- Users must not have been previously restricted by NutriStandard to use its Services, due to inappropriate behaviour or violation of the terms and conditions of use.
- Users must not impersonate other persons, businesses or other users, and must provide accurate information where asked to by NutriStandard and its employees.
- Users must not engage in unlawful, misleading, fraudulent or illegal activities in relation to the NutriStandard Services or other Users.
- Users must not buy, sell, or transfer any aspect of their account.
- Users must not interfere with or impair the intended operation of the NutriStandard Services.
- Users must not create accounts, access or collect information in an automated way without express permission from NutriStandard LTD, and must not make use of any of the NutriStandard Services with the purpose of information collection.

3.4 NutriStandard LTD kindly asks the Users to report any abnormal behaviour of other Users to the NutriStandard team as quickly as possible.

Art. 4 Copyright

4.1 NutriStandard LTD does not claim ownership of any content that Users share on or through the NutriStandard Services.

4.2 By using the NutriStandard services Users grant NutriStandard a licence to use any of the content shared, posted, or uploaded on or through the NutriStandard Services. When Users share, post, or upload content that is covered by intellectual property rights (like photos, videos or text) on or in connection with the NutriStandard Services, Users hereby grant to NutriStandard LTD a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of Users' content.

4.3 Users can only share, post, or upload content on or through the NutriStandard Services only if it doesn’t violate the intellectual property rights of another party. NutriStandard recommends Users to make sure that the content doesn’t violate copyright laws and the best way is to post original content, created by them.

4.4 Users can share another User’s content if it's permitted by the functionality of the NutriStandard Services or if they have permission or if they use it covered by fair use, or other exception to copyright law.

4.5 NutriStandard LTD cannot mediate the obtaining of permission for using any type of content and does not take any responsibility for improper use of copyright laws by the Users.

4.7 The content available through NutriStandard Services are property of the NutriStandard Users or NutriStandard LTD and are protected by UK copyright law.

4.8 NutriStandard LTD allows Users to create links to NutriStandard.com or to any other page on this website, under conditions that the site that offers the links do not violate intellectual property rights, do not contain offensive material and is not contrary to these terms and conditions of use. NutriStandard LTD reserves the right to demand removal of such links.

Art. 5 Price and Payment Methods

5.1 Price and Payment Methods for NutriStandard services are specified in every purchase made by the User of the NutriStandard Services. NutriStandard LTD will process payments through a partner payment processor. NutriStandard LTD or the payment processor will issue to the User a receipt for the delivered services. The User's obligation is to provide all the information needed by NutriStandard LTD to issue the receipt according to the law.

5.2 NutriStandard LTD will offer a receipt for the purchase made by the User exclusively in electronic format.

5.3 To ensure a correct communication between the User and NutriStandard LTD, the User is required to update the information associated with the account whenever necessary.

5.4 By accepting a purchase of the NutriStandard Services the User expresses its consent to receive the receipt in electronic format or by electronic post.

Art. 6 Privacy Policy

6.1 You can find the terms of the NutriStandard Privacy Policy listed in the Privacy Policy section on the NutriStandard.com website.

6.2 By using the website NutriStandard.com, installing the NutriStandard mobile application or in any way using or accessing the NutriStandard Services, you accept the terms and conditions of the Privacy Policy and the processing of your personal data. As a user, you are kindly asked to carefully read the Privacy Policy and the Terms and Conditions of Use before using the NutriStandard Services.

6.3 NutriStandard LTD will strive to maintain strict confidentiality of information and communication between the User, NutriStandard and its partners according to the EU GDPR legislation.

Art. 7 Changes to this agreement

7.1 From time to time, it may become necessary to make changes to these Terms and Conditions of Use. Therefore, we reserve the right to update and/or modify these Terms and Conditions of Use at any time, without prior notification.

Art. 8 Governing Law

8.1 These Terms and Conditions are governed by and in accordance with the laws of United Kingdom and any litigation will be solved by the United Kingdom legal system.

Art. 9 Agree to Terms and Conditions of Use

9.1 Usage of the NutriStandard.com website, NutriStandard mobile applications, and the NutriStandard Services requires acceptance of these terms and conditions of use. Otherwise Users, visitors or any other parties benefiting from the NutriStandard Services are asked to stop using the services, website or mobile application or to address the NutriStandard team for further information.

The information displayed in these Terms and Conditions and associated intellectual property are the property of NutriStandard LTD.

The date of the last modification is listed at the bottom of this Privacy Policy.
